How Much Does It Cost To File Bankruptcy?

Many individuals want to know how much it will cost to file bankruptcy before scheduling an initial consultation.  All bankruptcy legal fees must be disclosed to the Bankruptcy Court and are reviewed to ensure that the fee you are charged is fair and reasonable.  The following is a guide currently used by Levy Law Offices of the legal fees and costs for Chapter 7 bankruptcy legal fees and Chapter 13 bankruptcy legal fees.

 

Chapter 7 Fees:          $1000.00 to $1800.00 depending upon the complexity of the case

Chapter 7 Costs:         $299.00 - court filing cost

                                    $34.00 - credit counseling course cost

                                    $8.00 (per person) - financial management course cost

                                    $30.00 (single) or $50.00 (married) - credit report cost

                                    $29.00 - tax transcript cost

Payment in full of the legal fees and costs are required to be paid prior to the actual filing of the Chapter 7 case.  Representation begins with the signing of a fee agreement and portion of the legal fee.  Once you have retained Levy Law Offices, you may direct your creditors to contact the firm so that stress is removed from you.

In Chapter 7 cases, the entire legal fee and all costs must be paid to file your case.  The fees include preparation of your bankruptcy petition and schedules, representation at the § 341 Meeting and routine motions, and legal advice following your initial consultation (the initial consultation is free). 

 

Chapter 13 Base Fee:  Up to $3000.00

Up-Front Chapter 13 Fees:  $0.00 - $600.00, depending upon circumstances of case (this is a part of the Base Chapter 13 Fee)

Chapter 13 Costs:       $274.00 - court filing cost

                                    $34.00 - credit counseling course cost

                                    $30.00 (single) or $50.00 (married) - credit report cost

                                    $29.00 - tax transcript cost

In Chapter 13 fees, the up-front fee and the costs must be paid to file your case.

In Chapter 13 cases, Levy Law Offices tries to keep the up-front attorney fee as low as possible and considers the circumstances of the case in determining how much must be paid up front, and how much of the attorney fee is paid through the plan as a part of your monthly Chapter 13 plan payments.  Representation begins with the signing of a fee agreement (and possibly a portion of the legal fee).  Once you have retained Levy Law Offices, you may direct your creditors to contact the firm so that stress is removed from you.

Most, if not all, of the attorney fee in a Chapter 13 case is paid as a part of your monthly Chapter 13 plan payments to the trustee.  However, paying a larger portion of the Chapter 13 fee through the plan may cause your plan payments to be higher.  There may also be additional legal fees that are paid through the plan depending on the number of motions that have occurred in the case and the length of the case.
