In bankruptcy cases, it is often necessary for an out-of-state creditor to seek relief from the Bankruptcy Court for relief from the automatic stay to protect its interests in collateral. Creditors may also need representation in filing an adversary proceeding against the debtors in matters for which a motion is not sufficient or is not permitted by the Rules of Bankruptcy Procedure. Mr. Levy can assist creditors in these types of matters, on a flat fee basis for motions for relief from the automatic stay and on an hourly basis in adversary proceedings.
In certain circumstances when an individual sues a company, the plaintiff also names other individuals as separate defendants in the case. This is a common occurrence in claims involving sexual harassment, battery, tortuous interference with contract, and defamation. In some circumstances, the individual defendant may be required to retain separate counsel to protect his or her own interests. Other times, it is wise for the company to retain separate counsel for the individual out of an abundance of caution since the primary defense attorney might end up having to withdraw from representation from all defendants if a conflict of interest arises during litigation.
