North Carolina is a no-fault state. Consequently, acts by one spouse that lead to the breakdown of the marriage do not give the other spouse the right to a larger share of marital property. There are factors that may give a spouse a right to an award of more than 50 percent of marital property. These considerations are primarily based upon economic facts such as need, contributions to the marriage, and economic waste.
Child custody is determined based upon the best interests of the child. Child support is based upon the factors set forth in the North Carolina Child Support Guidelines, unless there is reason to deviate upward or downward. Custody and child support issues may be determined through agreement of the parties and then incorporated into a consent order. It is never a good idea to only have an oral agreement between the parents. These issues may also be decided by the court in litigation.
Post-separation support and alimony are based upon financial need and ability to pay. The length and amount of the award are based upon statutory factors. Marital misconduct may affect the right of a dependent spouse to an award of alimony.
Issues pertaining to support and property distribution may be resolved through a separation agreement and property settlement. These issues can also be determined by the court in litigation.
